Background:
JuWiLi II aims to enhance non-contentious proceedings through the integration of insights from behavioral economics. This work involves identifying best practices, analyzing behavioral drivers and barriers, and formulating actionable policy recommendations. The project builds on a multidisciplinary approach, combining legal expertise and economic analysis to improve procedural efficiency and access to justice.
Objective:
The selected partner will:
- Develop and implement behavioral economic methodologies to identify and evaluate best practices in non-contentious proceedings.
- Analyze drivers and barriers to effective behaviors in these proceedings.
- Design and pre-test interventions aimed at improving outcomes.
- Contribute to a comparative analysis of courtroom and notarial settings to evaluate framing effects and nudging mechanisms.
- Draft a comprehensive study and policy recommendations based on the findings.
Scope of Work:
The tasks will include:
- Questionnaire Development:
- Collaborate with the project’s economic and legal teams to draft, refine, and finalize a questionnaire that identifies best practices and barriers in non-contentious proceedings.
- Conduct online feedback loops and a pilot study to ensure validity and reliability.
- Behavioral Analysis:
- Conduct workshops introducing key behavioral mechanisms (e.g., hindsight bias, overconfidence bias).
- Facilitate brainstorming sessions to identify behavioral goals and potential interventions.
- Analyze motivators and barriers and propose policy interventions based on the data collected.
- Comparative Analysis:
- Conduct a field study comparing behavioral outcomes in courtroom and notarial settings using cooperation games and other experimental designs.
- Drafting Reports and Recommendations:
- Prepare a behavioral study summarizing the findings.
- Provide actionable policy recommendations aimed at improving procedural efficiency and fostering non-contentious dispute resolution mechanisms.
Deliverables:
- M1: Finalized questionnaire (Month 8)
- M2: Interim report summarizing pilot study results (Month 12)
- M3: Behavioral study draft (Month 18)
- M4: Final behavioral study and policy recommendations (Month 24)
Expected Expertise:
Applicants should demonstrate:
- Proven experience in behavioral economics research.
- Familiarity with non-contentious legal proceedings.
- Expertise in designing and conducting surveys and field experiments.
- Strong report-writing skills, particularly for policy recommendations.
- Collaborative experience in multidisciplinary and international projects.
Duration:
The project runs from January 2025 to December 2026, with key milestones outlined above.
